By accessing or using PineOptimizer ("Company," "we," "us," or "our" - operating under the legal business name PineOptimizer ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PineOptimizer provides GPU-accelerated strategy optimization and automated trading services for TradingView users. Our Service includes:

• Parameter optimization for PineScript strategies
• Backtesting with TradingView-compatible results
• Automated trading integration with supported exchanges
• Real-time monitoring and alerts

3. Risk Disclaimer

IMPORTANT: Trading cryptocurrencies and other financial instruments involves substantial risk of loss. Past performance and backtest results do not guarantee future results. You should only trade with money you can afford to lose.

PineOptimizer is not a registered investment advisor. The information and tools provided are for educational purposes only and should not be considered financial advice.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to:

• Provide accurate and complete information
• Keep your password and API keys secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Intellectual Property

Your PineScript strategies remain your property. We do not claim ownership of your code. All strategy codes are encrypted and stored securely, and are never shared with third parties.

6. Subscription and Payments

PineOptimizer offers one-time purchase plans (not recurring subscriptions). Each purchase grants access for a fixed period (e.g., 30 days, 90 days, or 365 days depending on the plan).

• Payments are processed via PayPal
• Plans are not automatically renewed
• You may repurchase at any time before or after expiration
• Access continues until the end of the purchased period

7. Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers. If you are not satisfied with our service, you may request a full refund within 7 days of your initial purchase.

• Applies to first-time purchases only
• Must be requested within 7 calendar days from purchase date
• Full refund with no questions asked
• Does not apply to renewed or subsequent purchases

8. Limitation of Liability

PineOptimizer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses.

9. Prohibited Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to reverse-engineer, decompile, or extract our algorithms
• Share your account credentials with others
• Use the Service to manipulate markets or engage in fraudulent trading
• Abuse the refund policy through repeated purchase-refund cycles
• Scrape, copy, or redistribute our content without permission

Violation of these terms may result in immediate account termination without refund.

10. Data Retention and Account Deletion

Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law or for legitimate business purposes (e.g., fraud prevention, legal compliance).

You may request account deletion at any time through your dashboard settings or by contacting support. Deleted accounts cannot be recovered.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the use of the Service shall be resolved through binding arbitration in Seoul, South Korea, or the courts of Seoul, South Korea.

12. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
